Indoor Air Quality Update

Important Notice Regarding DSHS’ Role in Indoor Air Quality

Effective September 1, 2015, indoor air quality statutes, as defined in Health and Safety Code (HSC) Chapter 385 and parts of Government Code (GC) 2165 regarding the Department of State Health Services’ (DSHS) responsibilities for indoor air quality were repealed.  These recent changes were enacted by Senate Bill (SB) 202, passed during the 84th Texas Legislature, Regular Session, and signed into law by the Governor.

SB 202 removes DSHS from having any responsibility for developing indoor air quality guidelines in government buildings or for investigating or testing indoor air quality in state buildings.  Remaining provisions of GC 2165 regarding indoor air quality in state buildings will continue to be the responsibility of the State Office of Risk Management and the Texas Facilities Commission.
